The Government of the Republic of India has notified the Government of Malaysia to terminate the Agreement between the Government of Malaysia and the Government of the Republic of India for the Promotion and Protection of Investments which will take effect on 23 March 2017.

Pursuant to paragraph 4 of Article 14 of this Agreement, existing Malaysian investors that have made or acquired investments in India prior to the date of termination shall continue to benefit from investment protection for a period of 10 years from the date of termination, i.e. until 22 March 2027.

Nonetheless, Malaysian investors may continue to benefit from investment protection under the existing bilateral and regional Investment Agreements, i.e. Malaysia-India Comprehensive Economic Cooperation Agreement (MICECA) and the Framework Agreement on Comprehensive Economic Cooperation between the Association of Southeast Asian Nations and the Republic of India (AIFTA), in which India is a Party thereto, provided that Malaysian investors fulfill the specific requirements under these Investment Agreements.
