  13. Please be informed that effective 1 November 2019, the Action Guidelines for Non-Compliance Cases in the Application for Import/Export of Iron and Steel Permit shall be enforced.

What is Approved Permit (AP)?

Approved Permit (AP) is an import and export license issued by the Permit Issuing Agencies (PIAs) under the Customs Act 1967.

Who are the PIAs?

There are several Ministries that issue AP for their respective/related product:

Which products are subject to AP under MITI?

1. Vehicle

All Motorvehicles and Motorcycles (including commercial vehicles) imported as Completely Built-Up (CBU) and Completely Knocked-Down (CKD).

 
2. Iron & Steel

Import of Iron and Steel Products under HS Code Subheading - 7208, 7209, 7210, 7211, 7212, 7225, 7227, 7303, 7304, 7305, 7306 and 7614.

Export of Iron and Steel Products under HS Code Subheading - 7204, 7404, 7503, 7602, 7802 and 7902.

 
3. Other Products

Import - Batik, used brake(s) and servo brake(s), reusable motorvehicle and motorcycle batteries.
Export - Waste Paper.

 
4. Heavy Machinery

           Import of Heavy Machineries under HS Code Subheading 8426, 8701, 8704 and 8705.

5. CWC Chemicals

Import of Toxic chemicals and their precursors covered under the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction 1993 (CWC).

The imposition of AP is based on the HS Code that they carry, which cross-reference can be made through http://tariff.customs.gov.my for guidance.

Of such, company is advised to ensure the correct HS Code for their product.

Conditions

Normal Import

  • Imported machineries must be less than 5 years from the manufacturing date.
  • Import must be accompanied by Certificate of Origin

Temporary Import

  • Machinery and Equipment's Imported can be aged more than 5 years calculated from Date of Manufacture
  • Importion of machinery only allowed for legitimate domestic work purposes
  • Machinery must be re-exported after project is completed or license expires.
  • License has to be renewed every 6 months

Re-Import

  • Re-importation only requires Customs original export (K2) form, AP not required.

1. Can I apply for AP without the H.S. Code confirmation from the Royal Malaysian Customs Department (RMCD)?

No, H.S. Code Confirmation is a mandatory document for e-Permit registration and application.

2. How long is the AP valid?

The AP is valid for six (6) months

3. I received documents in black and white, how to scan in color?

Indicate in the cover letter that documents are received in black and white from supplier or customer.

4. My shipment is urgent, can I request for early approval?

No, all application will be processed according to the client charter on a first come first serve basis.

5. My application has been rejected several times, can I request for immediate approval for the new application after correcting the mistakes?

No, all application will be processed according to the client charter on a first come first serve basis.

6. Can I make changes in the manufacturing certificate, invoice, certificate of origin after my application had been rejected?

No, if there is found evidence of modification to the manufacturing certificate, invoice, certificate of origin, it will be considered as an attempt of fradulent submission/document falsification.

Announcement For Iron and Steel AP

  1. Please be informed that effective 01 November 2019 Import License (AP) requirements from the Ministry of International Trade and Industry for the importation of iron and steel products under the H.S. code 7225.30.1000, 7225.40.1000, 7225.50.1000, 7225.50.9000, 7227.10.0000, 7227.20.0000 and 7227.90.0000 is repealed and replaced with Certificate of Approval (COA) requirements. For further information please refer to the P.U. (A) 228: Customs (Prohibition of Imports) (Amendment) (No. 3) Order 2019.   [Oct 11, 2019]

  2. Please be informed that effective 1 November 2019, the Action Guidelines for Non-Compliance Cases in the Application for Import/Export of Iron and Steel Permit shall be enforced.

    The Ministry takes seriously any mismanagement of import/export permit applications and the enforcement of these guidelines is one step towards ensuring that no elements of non-compliance or misappropriation of applications occur. For more information please email to ap@miti.gov.my.

1. Import Application Form

Form to be completed by applicant. All details must be accurate and similar to details in e-permit and documents attached with the application. Form is signed and officially stamped with date indicated.

2. Manufacturing License

Manufacturing License from MITI or Customs. Only applicable to Manufacturer applicant.

 

3. Business License

Business License from Local Authority. Only applicable to Trader / Service Centre applicant.

4. Cover Letter

Formal letter to MITI using the company letterhead requesting to apply  for an AP. To include explanation on the application.

5. H.S. Code Confirmation Letter from Royal Malaysian Customs Department (RMCD).

Letter from RMCD confirming the H.S. code of the imported product. To be attached together with the cover letter.

Note: The H.S Code Confirmation will be used as an application reference and not a determinant for approval.

6. Invoice / Performa Invoice / Sales Contract

Proof of purchase of Iron and Steel  products by AP applicant.

7. Mills Certificate

Certificate issued by the foreign manufacturer containing information and composition of the iron and steel products to be imported. Compulsory for Iron and Steel H.S. Code begining with 7225 and 7227.

Please ensure the International Standard and grade is of alloy steel.

8. Purchase Order from Local Buyer

Proof of order from local buyer in Malaysia.

9. Bill of Lading / Packing List

Document proving goods are ready for export to Malaysia.

10. Exemption Letter

Letter proving any exemption from import duty or tax for imported products.

11. Scrap Trading License from PDRM / Manufacturing License from MITI.

License indicating trading or manufacturing activity.

No, modification to mill certificate, invoice, purchase order or contract will be considered as forgery.

1. Why is the Customs Advance Ruling Letter required to replace Customs Classification Letter?

The implementation of the new requirement is to ensure that the imported products under Tariff Code 7225.99.9000 (Others Coated Alloy Steel) are correct and accurate.

2. Will the Customs Advance Ruling Letter be a permanent requirement?

The Customs Advance Ruling Letter will continue to be applied until a new mechanism is established.  (Currently, SIRIM and the Department of Standards Malaysia are in the process in developing a Malaysian Standards for products under HS Code 7225.99.9000)

3. What are the documents needed for this Customs Advance Ruling?

All documents needed can be found at:  http://www.customs.gov.my/en/pg/Pages/pg_crlapply.aspx.

4. Is the company allowed to apply for AP while waiting approval for the Customs Advance Ruling Letter from the Customs Department?

Yes. The company can apply for AP by submitting any documents to prove that the application for the Customs Advance Ruling has been made to the Customs Department.

5. If YES, what documents need to be submitted?

i. Official Receipt of Application for the Customs Advance Ruling by the Customs Department; and

ii. Acceptance Letter of Sample of Goods by the Customs Department.

6. Does the Customs Advance Ruling Letter requirement only apply to iron and steel products under HS Code 7225.99.9000?

Yes.

7. How long is the Customs Advance Ruling Letter valid for?

The Customs Advance Ruling Letter is valid for 3 years from the date of approval.

8. Can the same Customs Advance Ruling Letter be submitted for another AP application?

Yes. The same Customs Advance Ruling Letter can be submitted for subsequent applications if it is still within the validity period.

Importation of Batteries

MITI controls the importation of “Reusable batteries (accumulators) used for motor vehicles of headings 8701, 8702, 8703, 8704, 8705, 8709 and 8711”. In this context only reusable batteries for use of motorvehicles and motorcycles need Import License (AP) from MITI.

Importation of new batteries must be accompanied with SIRIM certificate which confirms the status and safety of the battery.

Used Batteries are prohibited from importation.
